Case summary
The court found that the plaintiff had duly bought the house and paid stamp duty charges. As such, no evidence had been adduced which justified the Commissioner’s refusal to release the relevant transfer documents to enable the plaintiff transfer the property into his own names. Accordingly, the court ordered the Commission to release to the plaintiff the transfer documents within 21 days of giving the judgment.     General damages of 12,000,000/= were ordered to be paid to the plaintiff as loss of use of his property, and costs of the suit.
