Case summary
Court considered the appeal on whether the sentence was excessive. The deceased had been assaulted by the appellants to whom he was a father and husband. In mitigation the 1st appellant pleaded that he was HIV positive and the sole bread winner to his family. Court considered other similar decision and reduced the sentence to 30 years looking at the 2 years spent on remand and the appellant’s age.
